Do I have a claim?

For a claim to succeed you must prove that someone was to blame for the accident and that you suffered loss or injury as a result of the accident.

What can I claim?

You can claim money (called "damages") for any personal injury, loss of earnings, medical treatment and reasonable expenses e.g. hire charges.

How do I claim?

Seek advice from a solicitor who is a specialist in PI claims, or contact us to discuss further.

When should I claim?

You should seek legal advice as soon as possible. You will then be advised on all aspects of your claim. If it is necessary to issue court proceedings they must be issued within 3 years of the date of your accident.

What will it cost me?

There are different ways to fund the claim. You may have legal expenses insurance to cover the costs. If not your solicitor will advise you how to proceed at no cost to you.

Will anything be deducted from the money I am awarded?

Some money will be deducted if you are partly to blame for the accident. The Clarke Partnership will not deduct anything from the money you are awarded.

How long will it take?

This depends on the complexity of your claim. It is unlikely that any claim will be concluded within 6 months, most will conclude within 12 months and more serious personal injury claims will take longer. The Clarke Partnership will deal with your claim without undue delay.

Will I have to go to court?

The majority of claims are concluded by negotiation either before or after court proceedings are issued. If you do have to attend court your solicitor will explain to you what will happen and answer any queries you have. You will be given advance notice to allow you to make arrangements at home or at work.

What if the other driver disputes the claim?

We will need to investigate the circumstances of the accident and take statements from you and any witnesses. We will advise you on the prospects of success.

What if the other driver is not insured or cannot be identified?

You are still entitled to claim through the Motor Insurers Bureau and The Clarke Partnership will advise you on the procedure to follow. The Motor Insurers Bureau deducts an excess of £300.
